NYSDOL has received the following questions regarding bid submission for RFP #Y-24 ACH Debit and Credit Card Payment and Data Processing Services. NYSDOL hopes this clarification will help the vendor community better prepare their bids.
Q1. Can bidders submit responses electronically, with the only paper delivered being the documents requiring original signatures?
A1. NYSDOL will accept the bid responses electronically, with scans and/or copies of the pages requiring a wet signature.
Q2. In light of Covid-19, is the State allowing vendors to submit the response electronically?
If the State is accepting electronic submissions, can the signature requirements be satisfied by a scanned image of a wet ink signature?
If the State is accepting electronic submissions, can the signature requirements be satisfied by specific formats or software that are acceptable (DocuSign, Adobe, other?)
Is the State willing to waive the notarization requirements for the various documents, provided the vendor agrees to subsequently re-execute any documents that require notarization?
If notarization is required, will the State accept remote notarization on vendor documents? And if so, are there any State approved or recommended remote notary vendors?
A2. NYSDOL will accept the bid responses electronically, with scans and/or copies of the pages requiring a wet signature. NYSDOL is abiding by Executive Order 202.7, Continuing Temporary Suspension and Modification of Laws Relating to the Disaster Emergency. Any notarial act that is required under New York State law is authorized to be performed utilizing audio-video technology provided that the following conditions are met:
Q3. Will the bid due date be extended?
A3. The bid due date has been extended to May 15, 2020. Please refer to the amended bid solicitation and the New York State Contract Reporter for the amended bid solicitation due date.
