EQUAL PAY

An employer may not pay different rates simply because of gender if men and women are employed in the same establishment to do equal work on jobs that require equal effort, skill, and responsibility, and which is performed under similar working conditions. The law does permit different rates of pay between employees, based on factors other than gender, such as length of service, and quality and quantity of work.

The Commissioner of Labor may enforce claims of workers based on violations of the Equal Pay Law in the same manner and with the same penalties as apply to any violation of the wage payment laws. Federal legislation also prohibits wage differentials based on gender in any establishment subject to the Fair Labor Standards Act..
