Professional Employer Organizations On March 23, 2003, the New York Professional Employer Act was signed into law. This act has a tremendous impact on businesses by requiring professional employer organizations (PEOs) throughout New York State to adhere to new requirements set forth by the State Legislature and enforced by the State Department of Labor. PEOs are now required to either register or obtain exemption and annually renew their registration or exemption status. Other requirements include proof of NYS Workers' Compensation and Disability Insurance, certification of the payment of taxes, content of contracts, and identity of clients.
