Important Information Regarding Explosive Regulations
New Pyrotechnic Regulations The Commissioner is promulgating these regulations on an emergency basis so that they can be in place in time to allow the Department to start accepting applications in August. Sections 61-6.1 (b), (c), (d), (e), (f) and (g) of these regulation will not become effective on October 4, 2009. Publication of regulations on an emergency basis allows them to take effect immediately, without requiring a prior waiting period for notice and comment by the public. While such regulations must still provide for formal public comment at a later date, the procedure does not provide any formal mechanism for prior public review and comment. The Department recognizes how valuable public comment can be in rulemaking and would like to provide an opportunity for the public to review the emergency regulations before they are published. Code Rule 39
The Department of Labor is in the process of reviewing its current regulations regarding the storage of explosives (Code Rule 39). Several groups have expressed concerns about the need for improved security for sites where explosives are stored. One of the solutions that has been put forward is to adopt regulations similar to those that were recently enacted in Pennsylvania, or those developed by the Institute of Makers of Explosives (IME). If you are not familiar with these regulations, we have provided links for you below.
