The Unemployment Insurance Appeal Board decides issues of unemployment insurance benefit eligibility and unemployment insurance contribution liability. The Board and its administrative law judges who conduct hearings are independent of the Department of Labor in making these decisions. It is the mission of the Unemployment Insurance Appeal Board and its administrative law judges to afford all parties a full and fair opportunity to be heard and to render decisions that are based on the record and are legally correct. The entire staff of the Unemployment Insurance Appeal Board are dedicated to serving the public. If you would like additional information, please contact us.
Certain aspects of the Appeal Board’s Attorney Fee Rule, Rule 460.6, [12 NYRR Part 460.6], are no longer being enforced: the definition of benefits allowed and the 20 percent cap on fees. Pending promulgation of a new Rule please refer to Labor Law section 538 and follow the instructions found in the “Certification of Services”, which can be found under the Resource tab on the UIAB website. For further guidance please call the Appeal Board at 518-408-0428.
