Apprenticeship Training Program Notice

Emergency/Proposed Regulations

Effective 7/2/09

 

 

 

On October 15, 2008, the New York State Department of Labor filed Emergency Regulations containing new monitoring and compliance responsibilities for apprenticeship program sponsors and signatories.  The Emergency Regulations were developed in response to recommendations made to the Commissioner of Labor following multiple reviews of the Apprenticeship Training Program conducted during the moratorium and were refiled as Emergency Rules on 1/12/09 and 4/10/09 while the Department continued to solicit public comment.  Drawing upon all these comments, the rules have been revised and have now been filed as Emergency/Proposed Regulations.  The content of the regulations includes the following:  

 

  • Establishment of a written public comment period for all proposed trades and program applications;  
  • Two-year probationary period for new program applications during which time a sponsor may not submit any new program applications;
  • Five-year recertification of all Apprenticeship Training programs;
  • Sponsors are required to provide information on signatories to Group Joint or Group Non-Joint programs;
  • Job rotation requirements and acceptable documentation;
  • Allows for the provision of related instruction by using electronic media; and
  • Voluntary deregistration or deactivation of programs lacking an apprentice for a one-year period.

 

Official notification regarding the filing of the Emergency/Proposed Regulations will be published in the New York State Register on July 22, 2009 at the following link:  http://www.dos.state.ny.us/info/register/2009.htm.    It is anticipated that these Regulations will be made permanent in October 2009.

 

The comment period for the Emergency Adoption/Proposed Rulemaking is open for 45 days following publication in the State Register.  Comments may be submitted to:  ATCO@labor.state.ny.us using a subject line of “Comments on Emergency/Proposed Regulations” or may be mailed to:
